Sudip Kundu is an experienced first-chair litigator with a focus on patent and trademark disputes. Sudip has successfully tried cases before federal district courts, the International Trade Commission, the U.S. Patent Office, and the International Chamber of Commerce. To date, Sudip has handled 16 ITC investigations, 23 IPR proceedings, and dozens of district court cases. Earlier in his career, Sudip prepared and prosecuted patent and trademark applications, providing him with a unique insight that he leverages to achieve successful outcomes for his clients.
Before joining DTO, Sudip worked at large corporate firms in New York and Washington, D.C., as well as his own litigation boutique, Kundu PLLC. While working in such diverse environments and representing a wide array of clients, Sudip developed a core principle: a lawyer's success is measured by the value the lawyer provides to clients.
Guided by this principle, combined with his broad experience and background, Sudip has achieved outstanding results for his clients throughout his career in complex and factually-challenging cases—results that centered on protecting and increasing his clients’ market share. These results included:
Defending a client’s business by successfully persuading a jury that the plaintiff competitor’s patent at issue—which the client acknowledged its product covered—was not used willfully and had only nominal value. The jury’s finding of no willfulness and a nominal damages award allowed the client to maintain and increase its market share, ultimately displacing the competitor.
Protecting clients’ businesses by persuading the International Trade Commission to issue exclusion orders barring patent infringing imports made by competitors and then successfully enforcing these orders in subsequent ITC investigations.
Advising clients on patent preparation and prosecution strategies leading to issued patents with high-quality claims that protected clients’ core technologies.
Defending a client’s business against trademark and trade dress infringement allegations by persuading the court there was no infringement as a matter of law.
When not practicing law, Sudip enjoys fostering the interests of his two young children, playing the tenor saxophone, and developing his burgeoning interest in geology.
